Terms of Service

These Terms govern your use of PopJar Media ("PopJar," "we," "us"), operated by SudoDog LLC. By signing up, paying, or using the service, you agree to these Terms.

1. The service

PopJar is a managed social-media service. You provide us with brand assets and delegated access to your social accounts; we draft, schedule, and ship posts on your behalf and, depending on your plan, perform engagement actions (likes, replies, follows) within scope. Specific deliverables per plan are described on our pricing page.

2. Your account

• You must be 18+ and authorized to bind the business whose accounts we'll manage.
• You're responsible for keeping your sign-in email secure. We use one-time magic links — anyone with access to your inbox can sign in.
• You agree not to share your account access with parties unauthorized by your business.

3. Content + ownership

• You retain all rights to your brand assets, voice, and any content we draft or generate on your behalf. You own the output.
• You grant PopJar a limited license to use your brand assets and voice for the sole purpose of operating the service.
• AI-generated visuals (images, videos) we produce for your campaigns are licensed for your commercial use under our tooling providers' terms (Imagen, Veo via Google AI; Anthropic Claude for drafting).
• You warrant that you have rights to any content you upload (logos, product photos, sample posts) and that none of it infringes third-party rights.

4. Acceptable use

You agree not to use PopJar to:

• Post unlawful, defamatory, harassing, fraudulent, or deceptive content
• Impersonate any person or business other than your own
• Promote regulated industries we can't legally serve (firearms, gambling, controlled substances, adult content, MLM schemes)
• Inflate engagement artificially (bot follows, paid likes) — we'll detect this and pause your account
• Reverse-engineer or republish PopJar's proprietary trend curation, playbook, or system prompts

We may pause or terminate your account, with refund of unused prepaid time, if we believe in good faith that you've violated this section.

5. Billing

• Plans are billed monthly via Stripe in advance. Annual prepay receives 2 months free.
• You can change plans or cancel at any time from your billing portal. Cancellation takes effect at the end of your current paid period — no prorated refunds for partial months.
• Failed payments trigger a grace period; if not resolved within 14 days, the account is paused.
• In-person customers paying via cash or check are billed on whatever schedule we agree to in writing.
• Founder-pricing rates are locked for the life of your continuous subscription. If you cancel and return, current pricing applies.

6. Service limits + reality

• Post counts per plan are ceilings, not guarantees. We will not pad weekly post quotas with low-quality content. If a week genuinely doesn't have material worth shipping at your ceiling, we'll ship less.
• We do not guarantee specific follower growth, engagement rates, or virality. Social media outcomes depend on factors outside our control.
• We do not guarantee posting cadence during platform outages, account suspensions you've caused, or extended legal/compliance reviews on our side.
• Pro-tier video generation is subject to a fair-use cap (~10 short clips/month). Extreme usage may be throttled.

7. Manual approval + autopilot

Depending on your plan, drafts go through your approval queue (Starter, default Growth) or are posted automatically (Growth/Pro opt-in autopilot). If you've enabled autopilot, you accept that we may post content you have not personally reviewed; we retain the right to refuse autopilot for any account where it poses risk.

8. Third-party services

To deliver the service, we use third parties including Cloudflare, Stripe, Resend, Anthropic, and Google. Their terms govern any data they process. We are not responsible for outages or terms changes on third-party social platforms (Meta, TikTok, X, etc.) that affect our ability to post.

9. Termination

• You can terminate any time, effective at end of current paid period.
• We can terminate with 30 days' notice for any reason, or immediately for violation of section 4.
• On termination, we delete your data within 30 days of request (see Privacy Policy). Your social account access is revoked by removing PopJar's roles in each platform.

10. Disclaimers + liability

PopJar is provided "as is." We disclaim implied warranties of merchantability and fitness for a particular purpose. To the maximum extent permitted by law, our aggregate liability for any claim arising from the service is capped at the fees you paid us in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages (lost profits, lost followers, reputational harm, etc.).

11. Governing law

These Terms are governed by California law. Disputes will be resolved in the state or federal courts located in Los Angeles County, California.

12. Changes to these Terms

If we make material changes, we'll email active customers at least 14 days before the changes take effect. Continued use after the effective date is acceptance.
